How long does the immigration process typically take?

Immigration timeframes vary significantly depending on the visa type, country of origin, current processing backlogs, and individual case complexity. Family-sponsored visas may take 1-10+ years, with immediate relatives of citizens (spouses, minor children, parents) generally processed faster (8-12 months) than other family preference categories. Employment-based visas range from 6 months to several years depending on category and country quotas. Naturalization applications typically take 8-12 months from filing to oath ceremony. Asylum cases may remain pending for years due to court backlogs. These timeframes are general estimates—current government processing times, request for additional evidence, security clearances, and administrative processing can all extend these periods. While we cannot expedite government processing, our firm maximizes efficiency by ensuring applications are complete, properly documented, and strategically filed, while providing transparent updates throughout the process.

What happens if my visa application is denied?

When a visa application is denied, several options exist depending on the specific circumstances. First, we conduct a thorough review of the denial reason to determine the appropriate course of action. For some denials, we can file a Motion to Reconsider or Motion to Reopen with the same immigration office if we can demonstrate a legal or factual error in the decision or present new evidence. In other cases, an appeal to a higher authority such as the Administrative Appeals Office or Board of Immigration Appeals may be appropriate. Alternative visa options might be available if the original category was inappropriate or if circumstances have changed. In certain situations, a waiver for the grounds of inadmissibility might be pursued. As a last resort, reapplying after addressing the reasons for denial could be considered for certain visa types. Our attorneys provide a comprehensive evaluation of your specific case to determine the most promising strategy for overcoming a denial and achieving your immigration goals.

What documents do I need for an immigration application?

Document requirements vary by immigration pathway, but typically include: identification documents (passport, birth certificate, national ID); immigration history documentation (current/previous visas, I-94 records); relationship evidence for family-based applications (marriage certificates, birth certificates showing parent-child relationships, adoption papers); financial documentation (tax returns, bank statements, employment verification); supporting evidence specific to your visa category (employment offers, educational credentials, business plans for investors); and application-specific forms and fees. Additional requirements may include medical examinations, police clearances, military records, affidavits of support, and photographs. Some documents from foreign countries may need authentication, certification, or translation. Our firm conducts comprehensive document assessments for each client's specific situation, creates customized checklists, identifies potential documentation challenges early in the process, and provides guidance on obtaining hard-to-secure records, ensuring your application is complete and properly supported.

Our Success Stories

Family Reunification Case

Complex Family Reunification After 15-Year Separation

Our client, a U.S. citizen, had been separated from his spouse and children for 15 years due to a previous immigration violation and subsequent bar to reentry. Despite multiple previous denials with other attorneys, we identified eligibility for a waiver based on extreme hardship. Through comprehensive documentation including medical records, psychological evaluations, financial impacts, and country conditions research, we built a compelling case. We prepared the family for consular interviews and advocated with the embassy when processing delays occurred. After an intensive 18-month process, the waiver was approved and the family was finally reunited in the United States after their decade and a half separation.

Employment Visa Case

Successful O-1 Visa for Distinguished Technology Entrepreneur

We represented a technology entrepreneur from India who had been denied H-1B visas twice previously. After careful analysis of his background, we identified eligibility for an O-1 "extraordinary ability" visa based on his innovative technology patents and industry recognition. We developed a comprehensive strategy to document his accomplishments, securing detailed recommendation letters from industry leaders, presenting evidence of his ventures' success, and demonstrating the impact of his innovations. After addressing a challenging Request for Evidence with supplemental materials and expert opinions, the O-1 visa was approved, allowing him to launch his U.S.-based technology company, which now employs over 20 American workers.
